Overview of the Investigation Process:
Disciplinary investigations against physicians by the Tennessee State Board of Medical Examiners and the Medical Licensure Commission of Tennessee have increased dramatically over the last few years. Often these complaints are initiated by a patient, competing practice, co-worker, employee, malpractice suit, negative peer review action, self-report of arrest or other violation on licensure renewal, insurance provider, negative evaluation, fellow physicians, anonymous complaints, or Board's own initiative. It is therefore important that upon notice that a hospital or medical staff peer review inquiry is being made into a physician's background or an evaluation is requested as part of the privilege application process you should immediately consult with an attorney. Any allegations of substandard care, malpractice, failure to maintain proper and accurate records and charts, sexual boundary violations or harassment, disruptive behavior, alcohol or drug abuse or dependency, off label prescribing should be taking seriously and responded too through an attorney. Also arrest, convictions, and even police incident reports not involving arrest should be reviewed by an attorney as they can have licensure implications.
Investigations are often initiated after a complaint and may be conducted initially internally without notice or by a letter and followed with a phone call from an investigator.
